Welcome to BocaServ (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of bocaserv.com and related services (the “Platform”). By using BocaServ, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Overview of Services
BocaServ is a local service marketplace where:
- Homeowners can submit service requests and connect with providers.
- Service Providers can create listings, receive requests, and submit proposals.
- Providers may purchase subscriptions, featured placements, or claim listings we pre-create for them.
BocaServ does not perform services directly. Contracts are between homeowners and service providers.
2. Eligibility
- You must be at least 18 years old to create an account.
- By registering, you confirm that the information you provide is accurate and up to date.
- Business listings may only be claimed by authorized representatives of the business.
3. Accounts
- You may register with email/password or social login (Google, Facebook, etc.).
- You are responsible for maintaining the confidentiality of your account.
- We reserve the right to suspend or terminate accounts for violation of these Terms.
4. Service Provider Memberships & Fees
- Providers may subscribe to membership plans for access to leads and directory listings.
- Fees, renewals, and cancellation terms are disclosed at checkout.
- Payments are non-refundable except as required by law.
5. Claiming Listings
- BocaServ may create directory profiles for local businesses using publicly available information.
- Authorized representatives may claim these listings by verifying their identity and relationship to the business.
- We reserve the right to deny or revoke claimed status if misrepresentation occurs.
6. Interactions Between Users
- BocaServ is not a party to contracts between homeowners and service providers.
- We do not guarantee the quality, safety, legality, or completion of any service.
- Users are solely responsible for reviewing, negotiating, and fulfilling their agreements.
7. Prohibited Conduct
You agree not to:
- Post false, misleading, or unlawful content.
- Misrepresent your identity or business affiliation.
- Attempt to interfere with the Platform’s security or functionality.
8. Intellectual Property
- All site content, branding, and technology remain the property of BocaServ or its licensors.
- Users retain rights to their own content but grant BocaServ a license to display it on the Platform.
9. Disclaimer & Limitation of Liability
- BocaServ is provided “as is” without warranties of any kind.
- We are not liable for damages arising from user interactions, service outcomes, or third-party disputes.
- To the fullest extent permitted by law, our total liability is limited to the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate access at our discretion, including for violations of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
12. Changes
We may update these Terms from time to time. Continued use of the Platform after changes means you accept the new Terms.
13. Business Listings and Claims
Free Business Listings
BocaServ publishes basic business listings using information gathered from publicly available sources, user submissions, and third-party directories. These listings are provided solely for informational purposes. BocaServ does not guarantee the accuracy, completeness, or timeliness of any unclaimed listing.
Claiming a Business
Businesses may request to claim ownership of their listing. Claiming a listing requires verification, which may include but is not limited to: confirmation by phone, email to a business domain, submission of business documentation, or other steps deemed necessary by BocaServ. By claiming a listing, the claimant represents and warrants that they are authorized to act on behalf of the business.
Accuracy of Information
Once a listing is claimed, the business is solely responsible for maintaining accurate and up-to-date information. BocaServ is not liable for any damages arising from inaccuracies, whether the listing is claimed or unclaimed.
Logos, Images, and Content
Unclaimed listings will not include logos or proprietary images unless they are publicly licensed or provided directly by the business. Businesses who claim a listing grant BocaServ a non-exclusive, royalty-free license to display their submitted logos, images, and descriptive content for the purposes of the listing.
Misrepresentation and Fraudulent Claims
Fraudulent or unauthorized claiming of a listing is strictly prohibited. BocaServ reserves the right to suspend or remove listings or accounts involved in misrepresentation, and may pursue additional legal remedies as appropriate.
Right to Remove or Modify
BocaServ reserves the right to modify, remove, or correct any listing at any time, whether claimed or unclaimed, in order to maintain accuracy, comply with law, or enforce these Terms of Service.
